Mike is not insane, but rather - "frustrated" by continuous government abuse and rejection of his lawful due process in North Dakota Courts. Undoubtedly, the community in which he resides has turned their backs on him in order to protect themselves from what can formidably be recognized as "targeting." Once our system gets what they feel is enough resistance from citizenry, they make them a target for the first law enforcement hand of least resistance to political repercussion, but most effective in demolishing their "target". You have obviously committed five other individuals to Mike's aid, and travesty which can beseech any one of us Fred. Only days earlier Mike phoned me and we discussed his situation in length. It was clear he would take a "careful" stance on his conduct in the meeting he planed to attend, and had some hope of a just conclusion. As with many folk who use the word "kill", "die", "suicide", and others, they are words said out of frustration and familiarity to getting attention, but not in the context of literal assumption or intent. Mike as with many of us are guilty "if you will" of similar things realizing full well that the reader or person hearing such phrases knows our intent. Does he get a feeling of worthiness and low self-esteem, not Mike. If he does, he prefers not to display it to his friends. point to wishing things would change, but little emphasis should be put to the words as they are a matter of depressive rambling and not intent. Many of us say "I wish I were dead", when having no such wish whatsoever. Folks will tend to say "I'll kill that ... or that..he..they can kill me if... or I won't leave my place.. or that place alive" with no intent placed on the adaptation of such phrases literally, and having no contextual cognition relative to intent. However, our enemy will jump on the opportunity and take advantage of the it to gain an unconscionable advantage. It becomes a weapon in the grasp of one who chooses to harm, defame, or injure another. Common folk unlike politicians, are ill-equipped in the use of self-protection against such contriving of another. In a "free" society Fred, we shall not be held accountable for such weakness or ineptness short of due process of law unless and until it becomes useful by said process. Having known Mike for several years, and having talked with him regarding his legal endeavor, it is imperative that he be released on his own recognizance and not further obstruct his rights and defame his character by demanding a Power of Attorney on his behalf. ================= Fred, It is also very possible that everything I said in my phone conversation with you and Mike was overheard by the authorities. I was counting on that perhaps occurring. Yes, I think Mike responds with too much visible emotion, but the system has no defense from cold hard facts, law, and publicity. I raised all of those in my conversation, and I think those are where and how Mike and you ought to focus. xxxxxxxxx Folks: Just as I was typing out a reply to one of the above messages, I got a call from Mike. Here are my rough notes as follows about todays hearing: psychologist was the only one mike could talk to mike was not allow to confront the police officer who signed the mental commitment letter mike asked, but was not allowed to introduce the email which was the entire basis for the mental commitment the judge assigned a lady lawyer who's got a BIG conflict of interest because her brother is/was one of the individuals who has extorted Mike - and who Mike is suing-prosecuting over the past 10+ years. mike's mother was there and he could not bring her up as a witness. they wanted to cut it short, cut him off so that they could send him back to where he is at for another two weeks they said. mike has been suing this same hospital for this is the 3rd time he's be admitted - twice by the same police officer - Lieutenant Chuck Rummel - who is one of the individuals that mike has been prosecuting for the past 10 years. what business does Chuck Rummel have in putting Mike away? Who complained to him? "And why should he complain since I am already suing him?" these questions were posed by Mike while I was on the phone with him The state didn't introduce Mike's email or anything as evidence that Mike is unfit to carryon with his life. the judge ruled that Mike needs treatment because he considers Mike "mentally unfit" but could cite no witnesses and evidence to that effect. The only witness who testified was a doctor who testified over the phone. Mike said he saw this doctor for only a minute. the doctor said that mike "is delusional for thinking he is a private attorney general of the united states." he said that mike's behavior was violent when he first came in. mike doesn't remember anything about the first 2 days for he said "they jabbed me with two needles in my leg." He went on to say "I remember when they brought me into the hospital in dickinson for that's where they jabbed me in the soft spot in my leg while I was on my stomach. He then said that "they jobbed be again with more shots when I entered the state hospital." He blacked out each time after these shots. Mike said he could not have been violent for he was passed out and he could not have been threatening anyone in that condition. ================= According to Mike, a "mental fitness" hearing is scheduled in two weeks. I guess by leapfrogging this initial meeting - ie. preventing the inclusion of any/all evidence which could be used to support his case against the state. We'll be in the process of contacting the news media to inform them of Mike's situation. Mike suggested that I/we simply send out Mike's "The Americans are Coming!!" email and ask them to comment before following up to tell them what happened because of this email. The question is, how could this happen in a free country? This kind of activity would sound very understandable in Saddam's Iraq or Castro's Cuba, but for this to take place here in America is quite a "wake up call." I'll have more to share later. The day before yesterday we had five individuals from all over the country, including Mike on a conference call as we were trying to assist him in gaining his composure while offering advice. There will be a hearing today before the hospital's medical team which Mike will appear at. The state of North Dakota did this to Mike 2-3 years ago. He was held for 2-3 weeks during that incident. As then, so it was this time: no charges, no court order, no due process. Mike does not have any idea as to who/what/when/where/how and why turned him into this "dangerous person" that needs to be locked up inside a state mental hospital. All Mike has been told by those who are keeping him is that he's being held because of what he wrote in his email. Perhaps this is the paragraph they are focusing on: "It is clear that they have been continuing their genocidal conspiracy to kill me by whatever means possible rather than to ever resolve this situation," he said. "But any further attempts to interfere with my federal legal activities and rights, or my person, will now be considered an assault against the United States and will be appropriately and forthrightly resisted to the death. This time I will not be leaving City Hall alive without a satisfactory conclusion to this tyranny, and the restoration of Constitutional government. This matter will be settled once and for all, one way or the other." Mike and I talked about this paragraph on the phone yesterday. He told me that he was simply stating what any policeman or public servant who has taken an oath of office must do to perform their duty to uphold and defend the Constitutions of their state and our Federal Government. He said "Fred, imagine if someone started to rape you mother. Is she to just stand there and let it happen?" He went on: "If someone assaults/attacks a policeman with a baseball bat, is he to just stand there and let it happen?" Based on what has happened - now documented on repeated occasions - this "system" that claims to hold power/control over the State of North Dakota has repeatedly interfered with Mike Nowik's legal activities, rights and his person. When you sum this up, it amounts to an assault against the United States. Mike is a very peaceful man. He's honest. He's an extemely intelligent guy, full of great energy and ideas and sometimes he gets wound up and frustrated by having to deal with the fact that there are so few individuals who can stand up and call themselves Americans. Mike Nowik is an American. Some may say he's misquided in his approach to his problems, but he does keep focused on the same path in attempt to resolve these issues, however bleak it may seem to others. If today's hearing does not go well, Mike may have to assign a power of attorney over to someone who can intervene directly and vouch for him to get him out of where he's at. Mike did not appear to be medicated as much as he was the day before. The phone system he's using was much better this time. I will update everyone as I get more information. A team of what he called "Swat agents" apprehended him off the street yesterday as he was leaving his home in Dickinson ND. He's now being held in a North Dakota State Mental Institution in Jamestown, some 200+ miles from Dickinson. He's been medicated and does not sound like he's fully cognizent of his surroundings. The phone connection was very bad. I could hear Mike very clearly, but he could not hear me. Very strange, odd. I kept asking him if he could hear me and it was as if he couldn't hear what I was saying. Perhaps his hearing or the earpiece in his handset was not working 100%. I called his home earlier in the day and spoke to what I believe is his elderly mother who has a very thick polish accent. She said he was "ok" but I didn't know what that meant. When asked for his wearabouts she said he was simply out doing some errands. Very strange, odd in light of what I later found out. Peace say a prayer for Mike Nowik. City, county, and state officials failed to appear at a scheduled news conference September 24th in response to a demand that representatives of the law, Constitution, and People of North Dakota appear, explain their actions and positions, and arrange settlement in their default of a decade long civil racketeering and torture case. That announcement had been distributed twice, to the White House, Congress, FBI, Justice Department, state and federal officials, media, and American citizens. "Officials or their representatives clearly had another reasonable opportunity to show up and demonstrate who's in charge here," Nowik, who called the news conference, said at that time. Those default damages continue to increase, are now in the billions of dollars, and are trebled under the civil racketeering laws. The case also involves the illegal, retaliatory, lifetime confiscation of Nowik's driver's license, with the unconstitutional condition that he resubmit to totalitarian state authority and drop his federal suit. Someone brought this to my attention a few years ago... Unbelievable!
As you may know the Censes is handled by the US Secretary of Commerce.
The SSN is just the tie-in to the Crown's chattel property (i.e. US
citizens) in regard to the US debt. See also the Brenton-Woods agreement. US
citizens are thrown the Social Security Program as a "bone" to get them sucked
in.
The Commerce Department handling the Census provides prima facie evidence
that US citizens are just considered economic commodities by the Elite.
The Census-in sense-is the inventory of the chattel property.

Chandara, your information with the Sabians symbols et al is
fascinating! Note the degrees 11 there. :-) 11s are showing up
all the time to the point where it's getting annoying. I don't mean
your information annoying; your information is enlightening for sure,
but I mean in the physical reality of clocks and stuff. It's like a
deluge of 11s everywhere and there's a significance that I don't grasp. One
night I asked to know why this 11 stuff keeps showing up when I looked at
my clock and it was 1:11 AM. That night my dog rolled over on the
curtain and unplugged the clock and in the morning i woke up thinking the
power was out! I don't know the answer anyway but it was interesting.
At night I sometimes lie awake and look at the digital clock and see
it's numbers upside down, then backwards, then from behind and upside
down and backwards. Two of those are the same but I can't do it in the
daytime so I can't say which two. Why this exercise? I don't
know. :-)
Something I'm hyperaware of is that I don't know much. Time is
zooming and folding back on itself. This "reality" is disconnected for me.
I've been exploring so many strange concepts and they all seem
disconnected: quantum physics, dream state, dream "injection,"
remote viewing, strange symptoms and telepathy out of control where
depressing feelings arise and anger arises, multi dimensional shifts, there
are lots of "beings" showing up all the time; they're everywhere. I've
been exploring, heavily, the 3 basic rules of schooling fish and
flocking birds. All of these people were trying to write a computer program
to map the swooping, turning, darting, movements of flocks and
schools. They discovered it would take like a million lines of code to
write this program that could replicate the movement. One guy worked on
it and discovered that the program could be written with only 3 simple
rules: 1.) Stay to center, 2.) Stay together, and 3.) Don't bump
into each other. So I took these 3 basic rules to see if they apply to
everything. From what I have looked at so far they do from
particle physics to walking with my dogs. This rule set is
called "intuitive logic" and is the antithesis of "reductionist logic" used by
science. Science can break stuff up into infinitely smaller parts but when
they get to the end of the logic the question, "why" remains. In
intuitive logic the "why" question is where it starts. Reductionist logic is
very complex. Intutitive logic is too simple to grasp.
So I'm rattling on, incoherently, about what is going on and have
no clue what it is actually. When I talk I replace letters in words
to make different words that make no sense and either I'm going nuts
or......and I suddenly go into this other place that is not here
but I don't know where it is....And you can all just ignore this and go

America began with "the shot heard round the world." Impassioned men andwomen fought against great odds to claim that great prize of liberty.
Scholar/Warrior/Diplomats gave their all in a fight to end the reign of atyrant king. King George and his "swarms of officers sent hither to harassour people and eat out our substance," were toppled from their wall by arag tag militia of tax protesters, determined to rule themselves as freemen.
They fought side by side as a guerrilla army of citizens and gentlemen. Thewar was largely a long series of retreats that eventually wore down theBritish, turning the tide with a few pivotal engagements.
As the American warriors gained their ground and sent the king's men backacross the sea, they became scholarly statesmen who crafted a revolutionarynew form of government and the American experiment of a ConstitutionalRepublic.
In the beginning, our republic followed the commands of the Constitutionwhich formed it. But it is the nature of power to seek to increase itself.Always.
The founders of our nation knew this tendency well and installed manychecks and balances in our national Constitution to limit any excessivecollections of power.
The Constitution breaks down the functions of government into threebranches and limits the acts and authorities of each one. This being good,but not good enough, the Founders added the Bill of Rights to spell outwhat rights the people had, thereby placing limits and duties upon thoseoperating within the general government.
Government or administrative regime?
If you bothered to look, you may find that the government set up by theConstitution is not the one we have operating today. Yes the Congress, theSupreme Court, and the Executive offices appear to be occupied, but whatforce of government actually reaches out and touches you?
Almost always, it is an administrative agency.
Article One, Section One, of the federal Constitution clearly states thatall legislative power shall be vested in the Congress. The founders' intentwas to require that the power to make law would remain accountable; thatonly those who were chosen to represent the people or the states could havesuch power; and if they abused that power they could be removed by electionor impeachment.
The Tenth Article of the Bill of Rights further declares limits to thatpower, commanding that the powers of the federal government are limited tothose enumerated by the Constitution and that all other powers are reservedto the states or the people respectively.
In the beginning this was the plan. The constitutional offices and areas ofgovernmental operation were few and limited in their scope. Constitutionalgovernment could never be expanded to regulate and meddle in so many areasof our lives. A sovereign people would yield a limited amount of theirsovereignty to a government which would serve them. In theory, the peoplewould remain master of their servant.
But, as Lord Acton stated: "power corrupts, and absolute power corruptsabsolutely." And absolute corruption in our age, has taken the form ofadministrative agencies.
The Code of Federal Regulations, also known as the CFRs, are unlegislated"laws" laid down by agencies themselves, in defiance of the Constitution'scommands. Further defiance of the supreme law takes the form of ExecutiveOrders where the President imposes "laws" made with the stroke of his pen.
This and many other transgressions have led to a corporate government thathas been super-imposed over our constitutional government.
Fascism, by definition, is the merger of corporate and state interestswhich vest power in a single authority. Ourmilitary-industrial-media-pharmaceutical-financiercontrolled-fascist-corporate-federal state has become such an authority.
We daily submit to it in cowardice and complicity. We feed it withallegiance and taxes we do not owe. We choose the illusions of liberty fedto us by its media over the freedom that would be ours if we were willingto undertake the effort to seize and maintain it. We support the granddeception and our own enslavement because we are cowards who choosecomplicity and compliance with the administrative, fascist state.
Remember, as we celebrate our "independence," what those brave souls whosigned the Declaration of Independence had to say about the king'sadministrative agencies:
"He has erected a multitude of new offices, and sent hither swarms ofofficers, to harass our people and eat out their substance."
Do you pay your taxes to an agency? Get permission to drive on "your"highway from an agency? Do agencies issue your permit to build a house, oroperate a business, or own a gun?
Is how you farm, or log, or hire a worker controlled by an agency? Does anagency regulate where you get your water from and where it goes to whenyou're done with it?
Isn't just about everything you use, buy, or own controlled by an agency?Does the Constitution create any agencies? No!
Do you see how we, as once free and brave Americans, now cowardly submit toinnumerable intrusions into our private lives by a host of agencies?
Have we become so placated by our plentiful possessions that we are nolonger willing to pledge our lives our fortunes and our sacred honor to thecause of freedom? Do we cower in complicity, surrendering our liberties forthe security and benefits offered by the socialist state?
Our Liberty Teeth
Guns used to be common and acceptable in American culture. It is, afterall, how we won our freedom from the English king and his agents.
Guns are the liberty teeth of the Bill of Rights. Right after the freedomof religion, to speak and publish, to peaceably assemble, and petition forredress, came the teeth.
The Second Amendment guarantees that each man may possess the means toterminate tyranny. It is nothing less than the right to keep and usewhatever force becomes necessary to maintain the high principles of ournational trust, the Constitution and that government which is founded by it.
It is nothing less than the right of each man to possess, withoutinfringement, the means by which he can put a permanent hole in the face oftyranny, thereby securing a free state, for himself and his posterity.
But with the socialist programming in the media and our government schools,our liberty teeth have been cast aside as an old set of dentures. The"Right to keep and bear arms" has atrophied because we no longer exerciseit. When was the last time you saw a private citizen openly carrying afirearm in a public place?
Many Americans would feel uneasy if their fellow citizens were openlyarmed. Most have succumbed to the programming that only the police andmilitary should bear arms for us. The social fascists win when American areintimidated into surrendering their rights.
The problem with tyrants is they just don't listen
Our legal remedies to redress the assault of agency intrusions includeletter writing to our legislators, voting, suing in court for our rights,or petitioning the executive officers or the agencies themselves.
Sometimes these work, but usually they require a monumental effort beforewe obtain any success. More often we fail to achieve any justice when weappeal to corrupted courts and executive officers. And legislators cannotafford to help ordinary citizens because they are indebted to the lobbyistswho represent the special interests that purchased their offices for them.
When these civil processes fail to achieve the desired result we are thenleft with a choice between accepting failure or applying the final solution:
The Second Amendment solution.
Perhaps we are too morally guided to use the Second Amendment solution asour founders did with great success. Like the death penalty, it has seentoo little use in our time to have any real effect. What percent of murdersresult in a conviction and the carrying out of a death sentence? Less thanone percent? Not hardly a deterrent to the murderer who knows the odds ofreceiving final justice.
Our tyrants in office and their agents in administrative regimes similarlyhave not recently been reminded that the Second Amendment applies to them.
Thus, they go on regulating to their hearts content as we suffer intrusionsand taxation beyond anything our Founders ever tolerated. And daily we submit!
Just before the American Revolution Samuel Adams said: "If ye love wealthbetter than freedom; the tranquility of servitude better than the animatingcontest of freedom, go home from us in peace. We ask not your counsel, noryou arms. Crouch down and lick the hands which feed you. May your chainsset lightly upon you. And may posterity forget that ye were our countrymen.
"Americans today do not seem to understand why we celebrate the Fourth ofJuly. It's not about sparklers and firecrackers, it's about remembering thereal bullets and real rockets fired in offense of freedom; it's aboutremembering those who dedicated their lives, their fortunes and theirsacred honor and were willing to give their all so that we could live in freedom.
And if we lose our freedom and, therefore, lose our country, how will ourposterity remember our contribution to their enslavement -- with a day ofsilence?
It's time to stand for something.

Are you a slave under some secret form of law?All of the "STATE OF" courts, such as circuit courts that are called "courts of record" (Oregon) and all (other) muni-corp courts that admit to being (non-courts of record — even thought they might have recording devices) have made it clear that everyone in the 50 commonwealth republics are the mere sentient property (slaves) of a silent and secret owner.
If you have any doubt that statement is true — then read on and study up on the 14th amendment and the federal meaning of "US citizen" or "US person."
For those who have studied the federal definitions of "United States", "State", and "US" among other words of legal art, we are forced to draw the conclusion that the government is acting under the presumption that we are federal property on the basis that we have stated on many forms that we are "US citizens" or "US persons."
Check your social insecurity form, voter registration forms and IRS forms. You have stated (sworn) under penalties of perjury that you are a US citizen / person.
They are operating under the legal axiom that, "One who swears to a fact is to be believed." The caveat for them is, "so long as it is to the governments benefit."
Try filing an affidavit that you are not a US citizen / person. They will do everything that they can to ignore it. Many of the less educated muni-corp judges will ignore it and even imprison you for contempt for wanting to know how he can ignore your affidavit.
If you want proof that you are under slave law, it is easy to prove. All law in America is delegated to the government from the people via the constitutions.
The Oregon commonwealth republic constitutions makes this very clear.
Article 1, Bill of Absolute Governmental Limitations a.k.a. Bill of Rights, Section 21. ... nor shall any law be passed, the taking effect of which shall be made to depend upon any authority, except as provided in this Constitution;...
The law cannot be more clear, and if you have any doubts, refer to the following:
Article IV, Legislative Department, Section 21. Every act, and joint resolution shall be plainly worded, avoiding as far as practicable the use of technical terms.
There is even an ORS (Oregon Revised Statute) to that effect:
Readability of Public Writings — 183.025 State agency required to prepare public writings in readable form; public input in rulemaking; definitions. (1) Every state agency shall prepare its public writings in language that is as clear and simple as possible.
(2) The Legislative Assembly finds and declares that it is the policy of this state that whenever possible the public be involved in the development of public policy by agencies and the drafting of rules. The Legislative Assembly encourages agencies to seek public input to the maximum extent possible before giving notice of intent to adopt, amend or repeal a rule. The agency may appoint an advisory committee that will represent the interests of persons likely to be affected by the rule, or use any other means of obtaining public views that will assist the agency in drafting the rule.
(3) As used in this section:
(a) "Public writing" means any rule, form, license or notice prepared by a state agency.
(b) "State agency" means any officer, board, commission, department, division or institution in the executive or administrative branch of state government.

One may find the above cases interesting in light of the fact that all codes, ordinances, rules and statutes, (city, county, state and federal) are written to be as vague as possible.
Here is a good question to the courts: Considering the law on vagueness, how can these be applied to me?"
One might even ask themselves how the law can be breached and the free People subjected to a system of laws and rules that clearly violate the basic principals of justice and even case law?
Lets go further with conflict of statutes so that when you go to court you will have lots of questions to ask the court.
If you go to the preface to the ORS and at the "Table of Titles," you will find the following:
"(1) Volume 1 contains the remedial code, dealing with court structure and organization and remedies (ORS chapters 1 to 55) and the Oregon Rules of Civil Procedure.
(2) Volume 2 contains the civil code, dealing with relationships between individuals (ORS chapters 56 to 130).
(3) Volume 3 contains the penal code, dealing with criminal procedure, crimes generally and punishment (ORS chapters 131 to 170)."
[Included within the penal code is the criminal code, with its own subsection, which lists all offenses that are crimes under the common law and that are considered as crimes in accordance with the constitution. ORS 161.005 gives an exact listing of all true crimes in Oregon. This takes up only parts of chapters 161 thru 167.]
"(4) Volumes 4 through 12 contain the political code, dealing with the structure and organization of state and local government and with the services rendered and the regulation exercised by government (ORS chapters 171 to 838)."

Please pay close attention to the fact that it relates only to state and local government (not to the people at large) and with the power of the government to regulate it’s own agencies and creations. Please also note just how many chapters that it takes up. A total of 667 or 79.6% of the whole code! The whole of the criminal code spread out over at least three times as much space as is actually needed (it has lots of "violations" interspersed with the "crimes") takes up only 0.83% of the whole code!
That means that less that 1% of the overall chapters have criminal laws that are enforceable upon the free People of the commonwealth republics! The list of crimes that apply to free People actually only accounts to less than ½ of 1% of all the written code!
On a federal level it is even less!
Under constitutional law, the government only has the power to regulate certain types of commerce, imports and exports, and its own housekeeping, but was left without any power to regulate the private activities of free men and women of the commonwealth republics, and the statutes, when carefully studied, clearly shows this.
What we are now learning is that all government in America has been replaced by sovereign municipal corporations, or as I call them, muni-corps.
From what I understand of the law, as applied to the Congress, these muni-corps are sovereign over whatever the Congress owns and puts them in charge of. If you study the cases on the 14th amendment, then it becomes clear the all muni-corps are sovereign over US citizens / person.
This is born out by the US Code (USC) TITLE 28 > PART VI > CHAPTER 176 > SUBCHAPTER A > Sec. 3002.

Sec. 3002. Definitions
(15) ''United States'' means -
(A) a Federal corporation;
(B) an agency, department, commission, board, or other entity of the United States; or
(C) an instrumentality of the United States.
For those who had doubts out the government being converted to a corporate status, you now have their own admission. How else could it have gotten around the gold and silver law?
Businesses owned by the Congress are just that — and operate under commercial law! Congress created the corporations and therefore congress can create the rules by which their business creation will do business and how it will handle its property. Art. 4, Sect. 3, Clause 2 makes it very clear the power the Congress has over its property.
Let’s get back to the ORS. The alcohol and drug (laws) are in chapter 475. All vehicle offenses are in the 800 series. These are a long way form the criminal code at 171.
Lets consider another really good question for the court that will get you imprisoned for contempt. "If the "Criminal Code of 1971" lists all constitutional crimes, how can free People of the commonwealth republics be imprisoned for alleged offenses (actions or inactions) described outside of that code?"
Lets explore this and see if I can make it even more interesting.
Under constitutional law, a culpable mental state, (mens rea or evil mind or intent) is required to be proven before conviction and before someone can be imprisoned or otherwise punished against their will. Lets see what the ORS says about this concept of law.
(1) ORS 161.105(b) states that it is the legislative intent to not require a culpable mental state for offenses that are not a part of the Oregon Criminal Code.
(2) ORS 161.105(a) states that any offense that does not require a culpable mental state is a "violation."
(3) ORS 153.008(2) it makes it very clear that you cannot be punished for conviction of a violation.
"153.008 Violations described. (1) Except as provided in subsection (2) of this section, an offense is a violation if any of the following apply:
(a) The offense is designated as a violation in the statute defining the offense. [Don’t forget 161.105]
b) The statute prescribing the penalty for the offense provides that the offense is punishable by a fine but does not provide that the offense is punishable by a term of imprisonment. The statute may provide for punishment in addition to a fine as long as the punishment does not include a term of imprisonment.
(c) The offense is created by an ordinance of a county, city, district or other political subdivision of this state with authority to create offenses, and the ordinance provides that violation of the ordinance is punishable by a fine but does not provide that the offense is punishable by a term of imprisonment. The ordinance may provide for punishment in addition to a fine as long as the punishment does not include a term of imprisonment.
(2) Conviction of a violation does not give rise to any disability or legal disadvantage based on conviction of a crime. "
The statutes are very clear that a free Citizen of the commonwealth republics cannot be imprisoned (jailed or otherwise held or incarcerated) for conviction of a "violation", yet our jails and prisons are full of people convicted only of violations.
Now lets look at the lawful meaning of disability:
Disability. The want of legal capability to perform an act. Term is generally used to indicate an incapacity for full enjoyment of ordinary legal rights; thus, persons under age, insane persons, and convicts are said to be under disability. Blacks Law Dictionary 5th Edition.
I think that 153.008 (2) is quite clear. Even if you are convicted of a "crime" and a "violation" at the same time, you cannot (shall not) be punished for conviction of the "violation."
Wouldn’t a mandatory fine or a term of imprisonment, such as jail, qualify as a disability or legal disadvantage? Prior to the 1999 revision there were sections that were even more clear and easy to understand regarding this. Also, under the law, jail time is considered imprisonment.
Since the ORS makes this bold and clear statement, how do the courts justify civil forfeitures for having drugs on your property — or the taking of your car without due process just because you did not have a drivers license, registration or proof of insurance on your body?
The ORS clearly states that these are only "violations" and that one shall not suffer a "legal disability" for the commission of.
Now lets look at the following statute.
"174.020 Legislative intent; general and particular provisions and intents. In the construction of a statute the intention of the legislature is to be pursued if possible; and when a general and particular provision are inconsistent, the latter is paramount to the former. So a particular intent shall control a general one that is inconsistent with it."
ORS 174.020 makes it very clear that if it ain’t part of the criminal code, its gotta’ be a "violation" and the State shall not punish you because that is the intent of the legislature.
FIY: ORS 801.555 admits again that all traffic offenses are only violations!
Now lets look at another statute of extreme importance.
174.030 Construction favoring natural right to prevail. Where a statute is equally susceptible of two interpretations, one in favor of natural right and the other against it, the former is to prevail.
Isn’t it a natural right not to be punished in a manner that was not delegated to the government from the people via the constitutions? Also here, the statutes clearly admit that they have sections that are against natural rights. By simple reading (as opposed to detailed studying) of the ORS, how is one to know what is prohibited and what isn’t?
According to well established law, the ORS is, by its own admission, void for vagueness. Here is a good question to go to jail for contempt for. "By what authority does the judge hold you accountable for rules that are "void for vagueness?"
Judges often claim to have the power to interpret the statutes, however I submit the following:
"174.010 General rule for construction of statutes. In the construction of a statute, the office of the judge is simply to ascertain and declare what is, in terms or in substance, contained therein, not to insert what has been omitted, or to omit what has been inserted; and where there are several provisions or particulars such construction is, if possible, to be adopted as will give effect to all."
How about demanding the judge tell you his authority to interpret the statutes? You bring up one thing in your favor, particularly the "violations" issue and demand to know how the judge can interpret the statutes to mean that you can be punished. The law states that it is a natural right to have the statutes interpreted in favor of the accused.
Now lets take a very quick look at the federal constitution, Article. III. Section. 2, Clause 2.
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.
The above paragraph appears to be the ultimate defense against all charges brought by the current State governments, as they all now bring the claim in the name of the State or the ‘people" without saying which people.
Since the corporate State is bringing the claim, the law demands that it do it ex rel, in the name of the people of the commonwealth republic that it represents when the claim or case is against a free Citizen of one of said republics. So how come they don’t?
If you want to go to jail, just demand that the judge disclose his authority or ignoring that federal law.
If you don’t think that you are mere property of the Congress via its muni-corp enforcement agencies, try studying all the previous statements of law and statute that appear to clearly state that the courts shall not do what they are doing — then, thru paperwork and open court questions pressure the D.A. and the judge for answers. If you do not simply shut up and drop the issue, you will find yourself imprisoned for "contempt of court."
If the legislatures and the muni-corps (incorporated cities and towns) can make any code, ordinance, rule or statute that they want, and you can be imprisoned for simply trying to find out the agencies constitutional authority to enforce any one of their rules upon you — then you cannot claim to be free. Only mere slaves can be denied access to the law that they are being prosecuted under.
If there is one most basic right that an American must hold in order to hang on to the illusion or delusion of freedom, it must be the right to "nature and cause."
If we ever any hope to push back any of the tyranny that had over taken our government and our judicial systems, it must be done in accordance with the law — ask questions — and keep them simple!
Look at the statutes and laws that state that free People have rights. Petition the D.A. and judge, under discovery for nature and cause, for full disclosure as to how you can be prosecuted in defiance of the written law and their own statutes.
When they deny you this discovery — sue them (under the right to nature and cause) for the authority of law that allowed them to apparently violate the laws and their own statutes.
Federal codes have clearly protected this right before under what is defined as "Brady Violations".

Evidence is "material" under BRADY if there is reasonable probability that, had evidence been disclosed to defense, result of proceeding would have been different.

Brady requirements that government disclose exculpatory evidence also applies at sentencing.
BARTHOLOMEW V. WOOD, 34 F3d 870 (9th Cir. 1994)
Prosecution’s failure to disclose material and favorable evidence to defendant will violate Due Process under BRADY, even when defendant makes no request for such evidence.
US V. ZUNO-ARCE, 44 F3d 1420 (9th Cir. 1995)
Under BRADY, exculpatory evidence cannot be kept out of hands of defense just because prosecutor does not have it, where investigating agency does.

1. "BRADY material" is any evidence, material either to guilt or punishment which is favorable to accused, irrespective of good faith or bad faith of prosecution.
2. Prosecutor’s duty to reveal BRADY materials does not depend on request by defense.

1. BRADY error occurs when government suppresses "material" information that is favorable to defense; information is "material" if there is a reasonable probability that, had the evidence been disclosed to defense, result of proceeding would have been different.

Prosecutor cannot get around the BRADY rule by keeping himself or herself in ignorance of exculpatory evidence.

To establish a BRADY claim, a habeas petitioner must demonstrate that:
(1) the prosecutor suppressed evidence;
(2) the evidence was favorable to the petitioner; and
(3) the evidence was material.
US V. QUINTANILLA, 193 F3d 1139 (10th Cir. 1999)
Whether a defendant knew or should have known of the existence of exculpatory evidence is irrelevant to the prosecution’s obligation to disclose the information to the defendant.
The law cannot be more clear — you have a right to know all the truth. Incompetent attorneys can also be sued as they are considered employees of the State — they just get their money from you. Therefore they qualify as "civil employees" or "public servants."
When the State supreme Court dismisses your case without comment — petition whomever signed the dismissal for a statement of the authority of law upon which they based their decision.
When the fails — under the right to nature and cause — sue them for the information. In leu of an answer, ask for compensation for your injuries on the basis that you suffered a legal disability due to their action, and if they can’t prove their action was lawful, the constitutions guarantee your right to compensation.
Consider a Petition for a Show Cause on the part of the defendant as to why they should not be summarily dismissed and banned from ever holding an office of public trust again.
If the federal court denies you the right to nature and cause, add their name to the conspiracy suit and take the case to the supreme Court of the united States.
The question is: "Do the people have a right to nature and cause?" The overall question clarified being:
(1) "If one is injured by the actions of a public servant, does that Person have the right to know the authority of law, as delegated to that servant thru the constitutions, for the injury inflicted upon him or her by that servant?"
(2) "If that servant cannot, or will not produce proof that the legal disability (injury inflicted) was lawful, does the injured party have a right to just and reasonable compensation as guaranteed in the constitutions?"
The question has already been answered — now clarify it and put teeth into it.
Do not convolute your case in any way. It must stay clean and pure so that the Court cannot avoid making a decision that can be published.
If they refuse to decide the case — their clear and publishable decision will be — all government is now the sovereign master and beyond the power of its creators to even question, much less control, and all the People are mere sentient property (slaves).
This now becomes a new stare decises standard in American law that can be quoted and published nationally and internationally.
America will never again be able to pretend to the international community that it has the least respect for the most basic rights of its people.
If the court sees the difficulty with that scenario, then it probably will not decide the case and create an up to the date new national decision.
Instead it will probably remand it back to the state with strict orders to deal with the issue or else. If the case is worded correctly, it could mean firing (voluntary retirement) of all named judges and a confidential payoff after negotiation.
If People get on the ball and start doing thousands of these cases in a proper manner with the will or move them all the way to D.C., then either the illusion of freedom will be finally put to rest — or the government will start to be a little more concerned with justice and fair play.
I still hope and believe that the pen can be mightier than the sword — or a band of communist Nazis’s in American police uniforms blindly enforcing federal slave law upon the free born People of the 50 commonwealth republics.
I realize that quite a number of the people in police uniforms simply enjoy enforcing their will upon other people, and would do it for free if they could afford it.
The majority, I believe, are simply and blinding following orders and trusting that what they are doing is correct, while feeling that they have no choice in the matter, and who would, if give the knowledge and opportunity, be happy to be much more just and kind.
The first we need to warn and then sue for answers, right along with the D.S.’s and judges in order to get rid of them.
The others we need to try and work with, in order to try to bring honor, justice and fair play back into police procedures.
Everyone should also be aware that every city employee, form meter reader, chief of police, city attorneys to the city muni-corp judge all answer to the "city manager". He can be set up and sued for their unlawful behavior under a suit requiring him to disclose "by what authority" he is allowing his employees to engage in acts that clearly appear to violate the law.
Where does s/he get the authority to allow Les Seymour Krime, working as the muni-corp judge, ...
Then list the actions of the muni-corp administrative judge that clearly appear unconstitutional. If you do your research, a muni-corp judge, or justice of the peace, has no power to fine or imprison. No one from a non-court of record has that power under the constitutions.
